1. Acceptance of Terms

By accessing or using ClickReach.io ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service. These Terms apply to all visitors, users, and others who access or use the Service.

2. Description of Service

ClickReach.io is an email outreach and contact management platform that allows users to create and manage email campaigns, store contact information, automate email sequences, and track email engagement metrics. The Service is provided "as is" and "as available."

3. Account Registration

To use certain features of the Service, you must:

  • Create an account with accurate and complete information
  • Be at least 18 years of age
  • Connect an authorized email service provider account (such as Gmail, Outlook, Zoho, or other supported providers) via OAuth or similar secure authentication methods
  • Maintain the security of your account credentials and connected email accounts
  • Notify us immediately of any unauthorized use of your account
  • Accept responsibility for all activities under your account

4. Email Service Provider Integration and API Usage

4.1 Connected Email Accounts

To use the email sending and management features of the Service, you must connect one or more email service provider accounts through secure OAuth authorization or similar authentication methods ("Connected Accounts"). By connecting an email account, you:

  • Represent and warrant that you are authorized to grant ClickReach.io access to such Connected Accounts
  • Acknowledge that ClickReach.io will access your Connected Accounts solely to provide the Service features you have requested
  • Understand that you can revoke access to Connected Accounts at any time through your email provider's security settings or through the ClickReach.io dashboard
  • Agree that ClickReach.io is not responsible for any changes, suspensions, or terminations implemented by your email service provider

4.2 API Data Usage and Compliance

When you connect email service provider accounts, ClickReach.io may access and temporarily process the following types of data to provide the Service:

  • Email metadata (headers, recipients, timestamps, message IDs) for tracking delivery and engagement
  • Email content for reply detection, bounce identification, and sequence management
  • Contact information and labels for campaign organization
  • Account settings necessary for email delivery optimization

4.3 Limited Use and Data Protection

ClickReach.io's use of data obtained from email service provider APIs is subject to strict limitations:

  • We access and use your email data solely to provide, maintain, and improve the Service features you have explicitly requested
  • We do not sell, rent, lease, or share your email data with third parties for their marketing or advertising purposes
  • We do not use your email data to build advertising profiles or for any purpose unrelated to providing the Service
  • We do not transfer email data to third parties except as necessary to provide the Service or as required by law
  • Access to email data is limited to authorized personnel who need it to provide support or maintain the Service

4.4 Email Service Provider Policies

Your use of Connected Accounts through ClickReach.io remains subject to your email service provider's terms of service and acceptable use policies. You are responsible for ensuring that your use of ClickReach.io complies with those policies.

5. Acceptable Use Policy

You agree NOT to use the Service to:

  • Send spam, unsolicited emails, or emails without proper consent
  • Violate any applicable anti-spam laws (CAN-SPAM, GDPR, CASL, etc.)
  • Send emails containing malware, phishing attempts, or malicious content
  • Impersonate others or misrepresent your affiliation
  • Harvest email addresses or personal information without consent
  • Violate any intellectual property rights
  • Interfere with or disrupt the Service or servers
  • Attempt to gain unauthorized access to any part of the Service
  • Use the Service for any illegal purpose

6. Email Sending Guidelines and Compliance

When using our email sending features, you must:

  • Have a lawful basis to contact each recipient
  • Include accurate sender information and a valid physical mailing address where required by law
  • Provide a clear and functional unsubscribe mechanism in all marketing emails
  • Honor unsubscribe requests within 10 business days
  • Not use deceptive subject lines or header information
  • Comply with all applicable laws including CAN-SPAM (US), GDPR (EU), CASL (Canada)

You acknowledge that you are the "sender" under applicable email and anti-spam laws and are solely responsible for ensuring compliance.

7. Data Processing and Privacy

With respect to personal data processed through the Service, you act as the data controller and ClickReach.io acts as the data processor. You are responsible for ensuring you have a lawful basis for processing personal data, obtaining necessary consents, providing required privacy notices, and responding to data subject rights requests.

8. Subscription and Payment

Paid subscriptions are billed in advance on a monthly, quarterly, or annual basis. You may cancel your subscription at any time, effective at the end of the current billing period. Fees paid are non-refundable except where required by applicable law. We reserve the right to modify pricing with 30 days' notice.

9. Intellectual Property

The Service, including its software and functionality, is owned or licensed by ClickReach.io and protected by applicable intellectual property laws. You retain ownership of your content but grant ClickReach.io a limited, non-exclusive license to use it solely to provide the Service.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CLICKREACH.IO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR ONE HUNDRED US DOLLARS (USD $100), WHICHEVER IS GREATER.

12. Account Termination

You may terminate your account at any time by contacting us at support@clickreach.io. We may suspend or terminate your access if you violate these Terms. You may request deletion of your data within 30 days of your request.

13. Dispute Resolution

These Terms shall be governed by the laws of India. The courts located in Ahmedabad, Gujarat, India shall have exclusive jurisdiction. Before initiating formal dispute resolution, we encourage you to contact us at support@clickreach.io to seek an informal resolution.
